The FEMA Trap: Agricultural Land

Inheritance is permitted; purchase is not. Before any transaction, we verify the land's classification and NA (bin kheti) status so you never sign an invalid deed.

No. Under FEMA regulations, NRIs and OCIs cannot purchase agricultural land, plantation property, or farmhouses in India — this applies fully in Gujarat, where agriculturist status rules add a further layer. NRIs can, however, inherit agricultural land. Residential and commercial property can be purchased freely. We verify the land classification before any NRI transaction to prevent an invalid purchase.

The legal heirs must first be recorded in the revenue records through a varsai (inheritance mutation) entry, supported by death certificate, heirship documents, and family details. Only after varsai is complete can the property be effectively sold or partitioned. We prepare the complete varsai documentation, obtain certified record copies, and coordinate the process remotely with NRI heirs.

When buying from an NRI seller, the buyer must deduct TDS under Section 195 of the Income-tax Act on the sale consideration — at rates significantly higher than the 1% applicable to resident sellers. NRI sellers can apply for a lower/nil TDS certificate from the Income Tax Department before the sale. We coordinate with your chartered accountant so the deed, payment schedule, and TDS documentation are consistent.
