The 4.9% comprises a basic duty of 3.5% under the Gujarat Stamp Act, 1958 plus a 40% surcharge (1.4%).

Correcting a common error: many websites and calculators state that women pay 3.9% stamp duty in Gujarat. That is incorrect. Stamp duty is 4.9% for all buyers. The concession for women buyers is the full exemption from the 1% registration fee — only nominal paging fees are payable at the Sub-Registrar's office. Duty Is Calculated on the Jantri Value (If Higher)

Stamp duty is charged on the higher of the transaction price or the jantri value — the Gujarat government's Annual Statement of Rates for the location and property type. Buying below jantri does not reduce your duty; understating the price in the deed only invites adjudication proceedings and penalties. Jantri rates have been under active revision in recent years, so always check the current applicable rate for your survey number before budgeting — or ask us to compute it as part of drafting.

Worked Example

Flat in Ahmedabad, agreed price ₹60,00,000 (assume jantri value is lower):

  • Stamp duty: 4.9% × ₹60,00,000 = ₹2,94,000
  • Registration fee (male buyer): 1% × ₹60,00,000 = ₹60,000 → total ₹3,54,000
  • Registration fee (woman buyer): ₹0 + paging fees → total ₹2,94,000 + paging fees

Other Documents, Other Rates

The 4.9% conveyance rate applies to sale deeds. Gift deeds between blood relatives, lease deeds, mortgage deeds, banakhat, and development agreements each attract different duty under the Gujarat Stamp Act — one of the most common drafting mistakes is paying duty under the wrong article. How Payment and Registration Work

Note that proper stamping is a precondition of registration: a deed that does not bear the appropriate stamp duty is not admissible for registration, and the Sub-Registrar will refuse it until the correct duty — plus any penalty on the deficit — is paid.

  2. The deed is executed by all parties with two witnesses
  3. Registration at the jurisdictional Sub-Registrar's office within four months — parties appear with photographs, identity documents, and biometrics
